Welcome to MPet – Pet Care Tracker, provided by MYNIQ Tech Solutions (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by this End User License Agreement and Terms of Use (the “Terms”). If you do not agree to these Terms, do not use the App.

1. ELIGIBILITY AND AGE RESTRICTIONS

You must be at least 13 years of age to use this App. By creating an account and using the App, you represent and warrant that you are 13 or older. We do not knowingly collect personal data from children under 13. If we discover that a user is under 13, their account and associated data will be immediately deleted. Users between the ages of 13 and 18 should have their parent or legal guardian review these Terms.

2. MEDICAL / VETERINARY DISCLAIMER

MPet – Pet Care is designed to help you manage your pet’s care, including scheduling, medication reminders, and vaccination records. However, this App does not provide medical or veterinary advice. * The App is not a substitute for professional veterinary diagnosis, treatment, or care.

  • Never disregard professional veterinary advice or delay in seeking it because of information tracked or read in this App.
  • We are not liable for any missed medications, missed appointments, or adverse health events regarding your pet resulting from app malfunctions, notification failures, or user error.

3. USER-GENERATED CONTENT (UGC) POLICY

Our App allows users to upload, share, and post content, including photos, pet profiles, mating records, and lost pet broadcasts (“User Content”). We have a zero-tolerance policy for objectionable content and abusive behavior.

A. Prohibited Content: You agree NOT to post, upload, or share any content that:

  • Is sexually explicit, pornographic, or contains nudity.
  • Promotes violence, self-harm, or cruelty to animals.
  • Is defamatory, abusive, harassing, threatening, or constitutes hate speech against any individual or group.
  • Promotes illegal activities or violates the intellectual property rights of others.

B. Reporting and Blocking: To ensure a safe community, the App includes the following safety features:

  • Report: You can flag inappropriate User Content or abusive users using the “Report” button within the App. We monitor these reports and commit to reviewing and taking action on reported content within 24 hours.
  • Block: You can block any user. Once blocked, you will no longer see their content, and they will not be able to interact with you.

C. Moderation and Banning: We reserve the right to remove any User Content at any time, for any reason, without notice. Users found violating this UGC policy will be permanently banned from the App without warning.

4. IN-APP PURCHASES AND SUBSCRIPTIONS

The App may offer premium features, virtual goods, or subscriptions via In-App Purchases (“IAP”).

  • Billing: All IAPs are processed through the respective app store (Apple App Store or Google Play Store). We do not collect or store your credit card information.
  • Refunds: Because payments are handled by Apple or Google, their respective refund policies apply. We cannot grant refunds directly.
  • Subscriptions: If you purchase an auto-renewing subscription, your account will be charged at the end of each billing cycle unless you cancel at least 24 hours before the cycle ends. You must manage your subscriptions in your device’s account settings.

5. ADVERTISEMENTS

The App is partially supported by advertising revenue and may display advertisements and promotions. You agree that we may place such advertising on the App in conjunction with your User Content. The manner, mode, and extent of such advertising are subject to change without notice.

6. LICENSE GRANT

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on a mobile device owned or controlled by you.

7. PRIVACY

Your privacy is important to us. Our data collection and use practices, including how we handle location data, photos, and pet records, are outlined in our Privacy Policy, which is incorporated by reference into these Terms. By using the App, you consent to our collection and use of personal data as outlined in the Privacy Policy.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, MYNIQ Tech Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; or (c) any conduct or content of any third party on the App.

9. ACCOUNT TERMINATION

We reserve the right to suspend or terminate your account and your access to the App at our sole discretion, without notice or liability, for any reason, including if you breach these Terms.

10. CHANGES TO THESE TERMS

We may modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of these Terms and, in some cases, providing a notification through the App. Your continued use of the App after the revised Terms have become effective indicates that you have read, understood, and agreed to the current version of the Terms.
